Hog farm bill lousy legislation
US - The bill in the Legislature that would take away citizen access to the courts on nuisances created by farms, including large hog farms, is a very poor and possibly unconstitutional piece of legislation.
It appears that it favors the rights of one group and takes the rights of others away, possibly violating the equal protection provisions of the federal constitution.
That aside, the bill sidesteps the real issue that the Legislature should be addressing in order to tackle the issue at hand. The real issue is zoning. Local jurisdictions, counties, need the ability to do land use planning and apply zoning.
Used properly zoning could help to avoid conflicts between farmers and their neighbors by protecting the interests of both. Zoning also could be used to protect both surface and groundwater resources, wetlands, critical wildlife habitats, historical and cultural resources and other special features.
