Farmers plan to continue with building hog barns despite ruling

US - Western Kentucky farmers say they will continue building and operating hog barns despite a state administrative ruling requiring them to ensure there are no waste discharges into creeks or harmful fumes from liquid manure pits.

A Kentucky Environmental and Public Protection Cabinet hearing officer on Friday recommended affirming construction permits, vacating operating permits and having more state review of water permits governing the injection of hog manure into the soil as fertilizer. Farmers may use construction permits as interim operating permits during the review and until the operating permits are issued or denied, the ruling said.

Cabinet Secretary Teresa Hill will review the recommendations and decide whether to apply them. Her decision can be challenged in court.
