State regulators are to allow up to 396,000 animals at the Greely County facility.

The move had met with opposition over whether the Ogallala Aquifer at the facility has enough water to treat the waste such a large number of pigs, a report from KMUW Wichita Radio said.

However, the report says that the Kansas Department of Health and Environment has signed off on a wastewater permit for the facility.

KDHE says the permit was issued in accordance with state and federal regulations.
